Justice Min: ‘we have the right to refuse to live’ with immigration

The Constitutional Court’s ruling that Hungary may apply its own measures wherever the European Union has not taken adequate steps to implement EU rules solely applies to immigration, “and we have the right to refuse to live with others”, Judit Varga, the justice minister, said on Friday.

“The Constitutional Court makes clear that we have the right to refuse to live with others who have not shared centuries of our common fate,” Varga said on Facebook.

Migration, she added, put “our sovereignty and identity” and “human rights and dignity” at risk. The minister said that Hungary, at the same time, remained a “committed member of the European Union”.

But today’s ruling signals that until EU rules on immigration are complete, Hungary has sole powers in this area and can change national rules with the aim of protecting its borders effectively, the minister added.

Varga said the court’s ruling created a “strong legal fence” alongside the physical one.

The minister said the dispute between Hungary and the European Commission highlighted the importance of rethinking immigration rules in Brussels.

Varga emphasised that the Constitutional Court had not examined whether EU law had primacy over national law. Neither was the Hungarian court procedure a review of the Court of Justice of the European Union’s ruling, she added.

Varga noted that in respect of the European court ruling on Hungary’s border laws, she had turned to the Constitutional Court on behalf of the government in February because complying with the ruling presented a constitutional conundrum.

The minister cited a clause in Hungary’s fundamental law that raised the question of whether an obligation arising from EU law may lead to a conflict since a foreign national would be staying illegally in Hungary for an indefinite period of time such that they effectively became a part of the population.

Varga said EU rules could not keep pace with the fast changing realities in the world. An increasing number of countries consider that current EU migration laws do not work in practice, she said. The rules are not up to the job of protecting Europe from illegal immigration, she added.

So EU member states must forge their own measures and tailored solutions to migration pressures, she said.

The minister noted that Brussels had taken exception to Hungary’s immigration rules maintained since 2015, and launched infringement proceedings. Last December, the EC declared that foreign citizen staying illegally in Hungary could not be escorted to the border and an asylum or expulsion procedure should be carried out instead, she noted.

In practice, however, illegal entrants would end up staying in Hungary if the authorities lacked legal recourse to sending them back through the border.

Hungary, Varga noted, dismantled transit zones after the European decision requiring it to do so.

“But we won’t let migrants in willy-nilly,” she said, adding that asylum applicants must turn to Hungarian embassies of neighboring countries as their first port of call. Varga noted that these countries were all safe.

  1. Hungary is a small country. It cannot and should not accept hordes, there is simply no room. Hungary should also not accept anyone with a culture that is contrary to the Hungarian norm. People from totally different cultures cannot assimilate. Less than 50% of illegal migrants of 2015 employed in regular jobs. Many are still employed in make work projects. Each country should evaluate its need and act accordingly. Hungary, however, is for Hungarians.

  3. Well Maria, people from different cultures can assimilate as shown in Canada. However, the problem is that the state NEEDS to make sure the migrants integrate. This can be done by making sure that the new migrants are taught the laws/rules of their host country and must abide by the laws or else they will be deported. If not, then you will get countries like Sweden whose’ immigration policies ran amok and now they are suffering crime waves.

  4. Judging from comments posted by xenophobic, racist orbanists, I would say that yes it is true that it can happen that migrants do not integrate. In fact, the magyars of Asian steppes have not yet integrated here in Europe. They arrived, took the land of others and refuse to live according to the rules of European society.
    They are a minority, though, for as barking as they may be.

These illegal migrants always had a choice to apply for legal entry, these people not only broke laws but lied because it is easier to be supported than go to work. 61 Per Cent of Spouse Killers in Switzerland Are Foreigners. According to DW, in Germany: Two-thirds of Syrian refugees unable to support themselves.

    Canada had a very good legal immigration system. Most immigrants were hand picked for their education, their qualification. The immigrants entering Canada applied legally, and were vetted. Canadian immigrants are the cream of the crop. They came here to work. There were a number of problems, Muslim man carrying out attacks, these attacks were classified as carried out by mentally ill persons rather than racism. A couple of years ago, a Muslim girl went public stating that she was attacked ad someone was pulling off her scarf. This was a hoax. These cases refer to refugees rather than legal immigrants.

    No employment statistic are available regarding refugees in Canada. In the EU, many middle-eastern refugees could not write or read in their own language. These people need financial support for at least 10 years. People cannot assimilate if they do not speak the language, understand their new home.

    Realist, you are right, in Canada, many people assimilated successfully. However, there are many areas which are inhabited by people of the same ethnic background. Brampton is an example. Assimilation takes time and it starts with the first generation born in the country and educated here. The aim is a united population that loves their new home country and live a peaceful and productive lives.

    It depends on the margin of victory. Some Hungarians may be getting complacent and ignore the danger these Soros represent to our Nation. After three huge victories, some of them may find better things to do than go to vote.
    The Hungarian patriotic core will vote but the enemies of Hungarian people will be financed by Soros, EU and Biden’s communist democrats. The CIA already has at least one agent in the Parliament. Hungarians must win and win big. That is the only way to shut-up the Soros dogs.

  8. But still no one is acknowledging that Hungary is a signatory to the 1951 Geneva Convention on Refugee Status and the 1967 Protocol thereof. All these statements made by the Hungarian government are for domestic consumption – the reality is that it is bound by that International Law to which it signed up to. It could of course withdraw as a signatory or it could rewrite or amend its constitution (as it has does in the past). Until either has taken place, it is all hot air.

    Article 1 of the Convention defines a refugee as:[10][11]
    As a result of events occurring before 1 January 1951 and owing to well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.

    Nothing here talks about mass migration from the Middle-East and Africa. Soros Open Society agents would like to pretend that these are refugees when The Truth is that they are NOT.

  11. Refugee act states, refugees must apply for protection in the first safe country (Dublin Regulation) The only way to apply for refugee status in Hungary if would be persecuted person flew directly into Hungary. Hungary is surrounded by safe countries.

    Hungary can always withdraw from treaties previously signed.

    For the Magyars, your point is mooted Mario. The Magyars assimilated with the local population thus that is why Hungarians do not look like their Central-Asian counterparts.

    Now for Maria, I agree that even with strong vetting process tragedies can happen. It It is important to avoid generalization. I can argue that while there are fake hate hoax (ex:Jussie Smollett), that are real hate crimes like a Muslim family in Quebec killed.

    THAT SAID, I do agree with your point that the problems in Sweden and Belgium is due to that lack of vetting process. I cannot fathom why those governments think having a weak vetting process is a good idea.

    I agree with the Hungarian government’s stance of having a strong border and immigration stance (which the opposition seems to agree to also). However, I think it is also important to refrain from using generalizations.

  13. The EU’s creeping globalist, communist dictates stop at Hungary’s borders.
    The EU, Soros, CIA supported opposition and foreign provocateurs may not like the will of Hungarian people but it is not their decision.
