According to blikk.hu, the European Court of Justice gave truth to one of the richest Hungarians, Gyorgy Gattyan, although NAV (National Tax Authority) wanted to encash him HUF 20 billion (EUR 64 million 516 thousand).
The Hungarian tax authority wanted to punish one of the richest Hungarian entrepreneurs and one of his companies called WebMindLicenses Ltd. – which operates livejasmin.com erotic website as well – with about HUF 20 billion. But now Gattyan hit back. The recent judgement of the European Court of Justice has favored him – magazine HVG wrote.
According to the case, NAV had a dispute on paying VAT and other taxes related to the services offered by the erotic website.
WebMindLicenses Ltd. is a member of Docler group belonging to Gattyan. The company leased know-how related to Livejasmin offering erotic services to a Portuguese company called Lalib. According to the tax authority, however, Gattyan evaded the Hungarian tax legislation with the license agreement between the two companies.
The businessman brought the case to the European Court of Justice, and on the basis of that decision, NAV could not have qualified the act of Gattyan as an abuse, based on the information available to the tax authority.
The body now passed the case back to the Hungarian court that likely obliges NAV to start a new procedure.
